This [**Website/ Application/ Services] is/are [**operated /provided/displayed] by Search Box Technologies. These terms and conditions ("User Terms") apply to your visit to and your use of the website and Services at www.lococabs.com (the “Website”) whether through a computer or a mobile phone, the Service and the Mobile Application (as defined below), as well as to all information, recommendations and or services provided to you on or through the Website, the Service and the Application. For the purposes of this User Terms, "Loco Cabs" shall mean Search Box Technologies. "You" and "your" means a person who meets the eligibility criteria set out below.

1. Important Points

Loco Cabs is an online marketplace for cabs. It does not own or operate taxi service. It is an online platform to searc,compare and book taxi services. To facilitate this, Loco Cabs has tied up with multiple cab/taxi operators.

Loco Cab's advice to customers is to choose Cab Operators they are aware of and whose service they are comfortable with.

A. RADIO CABS

Loco Cab's responsibilities include:

  • Displaying search results for the location from where the user has requested the service.
  • Displaying approximate fares for the destinations/locations provided
  • Displaying deals and offers provided by multiple cab operators

Loco Cab's responsibilities do NOT include:

  • The Cab operator's Cab not departing / reaching on time
  • The Cab operator's employees being rude
  • The Cab operator's Service etc not being up to the customer's expectation
  • The Cab operator's Service etc not being up to the customer's expectation
  • The baggage of the customer getting lost / stolen / damaged
  • The customer/user waiting at the wrong boarding point (please call the Cab operator to find out the exact boarding point if you are not a regular traveler on that particular Taxi Cab)
  • The Cab operator changing the boarding point and/or using a pick-up vehicle at the boarding point to take customers to the Cab departure point
  • The fares displayed on Loco Cabs are approximate estimates ONLY and may/may not include statutory taxes, parking charges, tolls and other incidental charges.

B. OUTSTATION/ TRANSFERS/HOURLY RENTALS/PACKAGES

Loco Cab's responsibilities include:

  • Displaying search results for the location from where the user has requested the service.
  • Displaying approximate fares for the destinations/locations provided
  • Displaying deals and offers provided by multiple cab operators
  • Providing reservation and cancellation facility for taxi reservations booked through the app or website ONLY.
  • Providing customer support and information in case of inconvenience

Loco Cab's responsibilities do NOT include:

  • The Cab operator's Cab not departing / reaching on time
  • The Cab operator's employees being rude
  • The Cab operator's Service etc not being up to the customer's expectation
  • The Cab operator's Service etc not being up to the customer's expectation
  • Cancellation of booking by Cab operator due to unavoidable circumstances.
  • The baggage of the customer getting lost / stolen / damaged
  • The customer/user waiting at the wrong boarding point (please call the Cab operator to find out the exact boarding point if you are not a regular traveler on that particular Taxi Cab)
  • The Cab operator changing the boarding point and/or using a pick-up vehicle at the boarding point to take customers to the Cab departure point
  • Cab operator changing the type of taxi cab due to some reason
  • The fares displayed on Loco Cabs are approximate estimates ONLY and may/may not include statutory taxes, parking charges, tolls and other incidental charges.
  • Passengers are required to furnish the following at the time of boarding the taxi:
    - Identity proof (Driving license, Student ID card, Company ID card, Passport, PAN card or Voter ID card). 
    Failing to do so, they may not be allowed to board the taxi.

  1. The arrival and departure times mentioned on the reservation are only tentative timings. However the Cab will not leave the source before the time that is mentioned on the reservation

  1. Cancellation Policy: The Cabs booked through Loco Cabs are cancellable, subject to the terms of conditions of the cab operators. Each cab operator has its cancellation policy. Loco Cabs advises users to read through the cancellation policy of the cab operator they are booking with before making the booking.

  1. Driver & car details - These details will be sent to the customer by an Operator approximately an hour before the pick up time by SMS and email.

Non receipt of driver and car details - In such cases the customer needs to contact the support team at Loco Cabs at +91-9028011022  and mention the booking reference number (CRN No)

  1. Ride Estimation shown on Loco Cabs is an approximate value, it may vary on the actual KMs travelled.

  1. In case a booking confirmation e-mail and sms gets delayed or fails because of technical reasons or as a result of incorrect e-mail ID / phone number provided by the user etc, a reservation will be considered 'booked' as long as the reservation shows up on the confirmation page of Loco Cabs App

  1. Demand of money by the driver- The voucher (bill) provided to the customer clearly indicates the items including on his booking. Any amount over and above this both in terms for distance and duration and other items such as night charges, driver allowance, toll, taxes, state taxes, charges on for extra Kms consumed if applicable, charges for extra hours consumed if applicable parking charges etc which are not included in the booking amount have to be paid directly to the driver as mentioned below. In case of any dispute with the driver the customer should reach the support team of Loco Cabs at +91-9028011022 and mention the booking reference number (CRN number) and mention the subject of dispute.

  1. Refusal by the driver to deliver services - The customer to contact the support team at Loco Cabs at +91-9028011022 and mention the booking reference number (CRN number).

  1. Refunds – Loco Cabs will initiate refunds for cancellations adhering to the cancellation policies of the cab operator. The transactions charges and other incidental charges may not be refunded in the event of reservation cancellation. Refund will be made online ONLY; no cash requests will be made or entertained. In case of dispute, please write to support@lococabs.com.

10. Loco Cabs does not warrant or make any representations regarding the use of or the result of the use of the material on the site in terms of their correctness, accuracy, reliability, or otherwise, insofar as such material is derived from other service providers.

Loco Cabs will not be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by you through your usage of this Site. In no event shall Loco Cabs be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of information provided on the Mobile App in so far as such information is derived from other service providers.

By making a reservation with an Taxi Cab provider, you accept and agree to the relevant cancellation and no-show policy of that Taxi Cab provider, and to any additional (delivery) terms and conditions of the Taxi Cab provider that may apply to your reservation or during your travel use, including for services rendered and/or products offered by the Taxi Cab provider (the delivery terms and conditions of an Taxi Cab provider can be obtained with the relevant Taxi Cab provider). The general cancellation and no-show policy of each Taxi Cab provider is made available on our Mobile App on the Taxi Cab information pages, during the reservation procedure and in the confirmation email. Please note that certain rates or special offers are not eligible for cancellation or change. Please check the Taxi Cab details thoroughly for any such conditions prior to making your reservation. Please note that a reservation which requires down payment or (wholly or partly) prepayment may be cancelled (without a prior notice of default or warning) insofar the relevant (remaining) amount(s) cannot be collected in full on the relevant payment date in accordance with the relevant payment policy of the Taxi Cab and the reservation. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Taxi Cab agrees or allows otherwise under its (pre)payment and cancellation policy.

If you wish to review, adjust or cancel your reservation, please revert to the confirmation email and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the Taxi Cab provider's cancellation, (pre)payment and no-show policy or not be entitled to any repayment of any (pre)paid amount. We recommend that you read the cancellation, (pre)payment and no-show policy of the Taxi Cab provider carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.

Cabs booked on the partner App or website may have their own cancellation policy and may charge user accordingly. Cancellations for bookings done through Loco Cabs can be initiated through Loco Cabs only.

11. Link To Third Party Website:

During the use of the Website or the Application, links to websites that are owned and controlled by third parties may be provided from time to time in order to enter into correspondence with, purchase goods or services from, and participate in promotions of third parties. These links take you off the Website, the Application and are beyond the Company's control.

During use of the Website and the Application, you may enter into correspondence with, purchase goods and/or services from, or participate in promotions of third party service providers, advertisers or sponsors showing their goods and/or services through a link on the Website or through the Application or Service. These links take you off the Website, the Application and the Service and are beyond the Company's control. The websites you can link to have their own separate terms and conditions as well as a privacy policy. The Company is not responsible and cannot be held liable for the content and activities of these websites. You therefore visit or access these websites entirely at your own risk.

Please note that these other websites may send their own cookies to users, collect data or solicit personal information, and you are therefore advised to check the terms of use or privacy policies on those websites prior to using them.

Loco Cabs will not be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of the information derived by you through your usage of this Site. In no event shall Loco Cabs be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of information provided on the website in so far as such information is derived from other service providers.

  1.  Communication Policy

  1. By accepting the terms and conditions the customer accepts that Loco Cabs may send the alerts to the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer. The customer acknowledges that the alerts will be received only if the mobile phone is in ‘On’ mode to receive the SMS. If the mobile phone is in ‘Off’’ mode then the customer may not get / get after delay any alerts sent during such period.
  2. Loco Cabs will make best efforts to provide the service and it shall be deemed that the customer shall have received the information sent from Loco Cabs as an alert on the mobile phone number provided during the course of ticket booking and Loco Cabs shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. The customer cannot hold Loco Cabs liable for non-availability of the service in any manner whatsoever.
  3. The customer acknowledges that the SMS service provided by Loco Cabs is an additional facility provided for the customer’s convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the customer observes any error in the information provided in the alert, Loco Cabs shall be immediately informed about the same by the customer and Loco Cabs will make best possible efforts to rectify the error as early as possible. The customer shall not hold Loco Cabs liable for any loss, damages, claim, and expense including legal cost that may be incurred/ suffered by the customer on account of the SMS facility.
  4. The customer acknowledges that the clarity, readability, accuracy, and promptness of providing the service depend on many factors including the infrastructure, connectivity of the service provider. Loco Cabs shall not be responsible for any non-delivery, delayed delivery or distortion of the alert in any way whatsoever.
  5. The customer agrees to indemnify and hold harmless Loco Cabs and the SMS service provider including its officials from any damages, claims, demands, proceedings, loss, cost, charges and expenses whatsoever including legal charges and attorney fees which Loco Cabs and the SMS service provider may at any time incur, sustain, suffer or be put to as a consequence of or arising out of (i) misuse, improper or fraudulent information provided by the customer, (ii) the customer providing incorrect number or providing a number that belongs to that of an unrelated third party, and/or (iii) the customer receiving any message relating to the reservation number, travel itinerary information, booking confirmation, modification to a ticket, cancellation of ticket, change in taxi schedule, delay, and/or rescheduling from Loco Cabs and/or the SMS service provider.
  6. By accepting the terms and conditions the customer acknowledges and agrees that Loco Cabs may call the mobile phone number provided by the customer while registering for the service or to any such number replaced and informed by the customer, for the purpose of collecting feedback from the customer regarding their travel, the taxi facilities and/or services of the taxi operator.
  7. Grievances related to the taxi journey should be reported to Loco Cabs support team within 10 days of your travel date.

h. We retain the right to collect and use any Non Personal Information collected from your use of our Website or App and aggregate such data for internal analytics that improve our Website or App and Service as well as for use or resale to others. At no time is your Personally Identifiable Information included in such data aggregations.

General Terms and Conditions:

  • The Company provides technology based services for booking taxis on PAN-India basis to you and you agree to obtain taxi services offered by third party taxi providers, drivers or vehicle operators ("the Service Provider"). All the Services provided by the Company to you by means of your use of the booking platform are hereinafter referred to as the "Service."
  • The Company shall take your booking request and forward it to the Service Provider. The Service Provider shall have the sole discretion to accept or reject each request for taxi service. The Service Provider has discretion over whether to receive the booking request made by the Company.
  • The Company shall make reasonable efforts to bring you in contact with the Service Provider in order to obtain taxi Service subject to availability of the Service Provider in or around your location at the time of your booking request made to the Company.
  • For the avoidance of doubt, it is clarified that the Company itself does not provide taxi services. It is the Service Provider who shall render taxi service to you. The provision of the taxi services by the Service Provider to you is therefore subject to the agreement (to be) entered into between you and the Service Provider and the Company shall never be a party to such agreement. Even after acceptance of booking, the Service Provider may not reach your pick up location or decide not to render his services in which event the Company shall not be held liable to you.
  • You warrant that the information you provide to the Company is accurate and complete. The Company is entitled to at all time verify the information that you have provided. You may only access the Service using the authorized means. It is your responsibility to check to ensure you download the correct mobile application for your device or visit the correct portal or dial-in the accurate call center number. The Company shall not be liable if you do not download the correct mobile application or visit the appropriate web portal or dial-in the correct call center number. The Company reserves the right to discontinue or introduce any of the modes of booking Taxi.
  • You will refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation;
  • You will comply with all applicable laws;
  • You will treat taxi drivers introduced to you through us with respect and not to cause damage to their taxi or engage in any unlawful, threatening, harassing, abusive behaviour or activity whilst using their taxi or the service;
  • You will compensate and defend us fully against any claims or legal proceedings brought against us by any other person as a result of your breach of these Terms.
  • Please note that we are not responsible for the behaviour, actions or inactions of drivers of taxis, quality of cab which you may use (through us or otherwise). Any Contract for the provision of taxi services is between you and the driver and not us and we simply provide a platform to introduce drivers and passengers.

By using the mobile Application of the Company, you further agree that: 

  1. You will download the Application for your sole, personal use and will not resell it to a third party;
  2. You will not authorize others to use your account;
  3. You will not assign or otherwise transfer your account to any other person or legal entity;
  4. You will not use an account that is subject to any rights of a person other than you without appropriate authorization;
  5. You will not use the Application for unlawful purposes, including but not limited to sending or storing any unlawful material or for fraudulent purposes;
  6. You will not use the Application to cause nuisance, annoyance or inconvenience;
  7. You will not impair the proper operation of the network;
  8. You will not try to harm Application in any way whatsoever;
  9. You will not copy, or distribute the Application or other Company Content without written permission from Company;
  10. You will keep secure and confidential your account password or any identification we provide you which allows access to the Application;
  11. You will provide us with whatever proof of identity we may reasonably request;
  12. You will only use an access point or 3G data account (AP) which you are authorized to use;
  13. You will not use the Application with an incompatible or unauthorized device;
  14. You will comply with all applicable law from your home nation, the country, state and/or city in which you are present while using the Application.

The Company reserves the right to immediately terminate use of the Application should you not comply with the any of the above rules.

Indemnification:

By accepting these User Terms and using the Application, you agree that you shall defend, indemnify and hold the Company, its affiliates, its licensors, and each of their officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these User Terms or any applicable law or regulation, whether or not referenced herein; (b) your violation of any rights of any third party, including Service Providers arranged via the Application, or (c) your use or misuse of the Application or Website.

Liability:

  • The information, recommendations provided to you on or through the Website, or the Application is for general information purposes only and does not constitute advice. The Company will reasonably keep the Website and the Application and its contents correct and up to date, but does not guarantee that (the contents of) the Website and/or Application are free of errors, defects, malware and viruses or that the Website and/or Application are correct, up to date and accurate.
  • The Company shall not be liable for any damages resulting from the use of or inability to use the Website or Application (but to the exclusion of death or personal injury), including damages caused by malware, viruses or any incorrectness or incompleteness of the Information or the Website or Application, unless such damage is the result of any wilful misconduct or from gross negligence on the part of the Company.
  • The Company shall further not be liable for damages resulting from the use of (or the inability to use) electronic means of communication with the Website or the Application, including – but not limited to – damages resulting from failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.
  • The quality of the taxi services requested through the use of the Application or the Service is entirely the responsibility of the Service Provider who ultimately provides such taxi services to you. The Company under no circumstance accepts liability in connection with and/or arising from the taxi services provided by the Service Provider or any acts, action, behaviour, conduct, and/or negligence on the part of the Service Provider. Any complaints about the taxi services provided by the Service Provider should therefore be submitted to the Service Provider.

INTELLECTUAL PROPERTY RIGHTS (Trademarks and Copyrights):

  • The Company is the sole owner and lawful licensee of all the rights to the web site, mobile application or any other digital media and its contents. The content means its design, layout, text, images, graphics, sounds, video, etc. the website, mobile application or any other digital media content embody trade secrets and intellectual property rights protected under worldwide copyright and other laws. All titles, ownership and intellectual property rights in the website and its content shall remain with the Company, its affiliates, agents, authorized representatives or licensor's as the case may be.
  • All rights not otherwise claimed under this Terms and Conditions or by the Company are hereby reserved. The information contained in this web site is intended, solely to provide general information for the personal use of the reader, who accepts full responsibility for its use.
  • The Company does not represent or endorse the accuracy or reliability of any information or advertisement contained on, distributed through, or linked, downloaded or accessed from any of the services contained on this website, or the quality of any products, information or other materials displayed, or obtained by you as a result of any product, information or other materials displayed, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the service.
  • All the contents on this web site is copyright of the Company except the third party content and link to third party website on our website.
  • Subject to your compliance with these Terms, the Company grants you a limited non-exclusive, non-transferable license to download and install a copy of the Application on a single mobile device that you own or control and to run such copy of the Application solely for your own personal use.
  • You shall not (i) license, sublicense, sell, resell, transfer, assign, distribute or otherwise commercially exploit or make available to any third party the Application in any way; (ii) modify or make derivative works based upon the Application; (iii) create Internet "links" or "frame" or "mirror" any Application on any other server or wireless or Internet-based device; (iv) reverse engineer or access the Application in order to (a) design or build a competitive product or service, (b) design or build a product using similar ideas, features, functions or graphics of the Application, or (c) copy any ideas, features, functions or graphics of the Application, or (v) launch an automated program or script, including, but not limited to, web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses or worms, or any program which may make multiple server requests per second, or unduly burdens or hinders the operation and/or performance of the Application.

Term and termination of the contract:

The Contract between the Company and you is concluded for an indefinite period. You are entitled to terminate the Contract at all times by permanent deletion of the Application installed on your smart phone, thus disabling the use by you of the Application and the Service.

Company is entitled to terminate the Contract at all times and with immediate effect (by disabling your use of the Application and the Service) if you: (a) violate or breach any term of these User Terms, or (b) in the opinion of the Company, misuse the Application or the Service. The Company is not obliged to give notice of the termination of the Contract in advance. After termination the Company will give notice thereof in accordance with these User Terms.

Invalidity of one or more provisions:

The invalidity of any term of these User Terms shall not affect the validity of the other provisions of these User Terms.

If and to the extent that any provision of these User Terms is invalid, or is unacceptable in the given circumstances according to the criteria of reasonableness and fairness, a provision shall apply between the parties instead that is acceptable considering all the circumstances and which corresponds with the provisions of the void part as much as possible, taking into account the content and the purpose of these User Terms.

Modification of the Service and User Terms:

The Company reserves the right, at its sole discretion, to modify or replace any of these User Terms, or change, suspend, or discontinue the Application (including without limitation, the availability of any feature, database, or content) at any time by posting a notice on the Website or by sending you notice through the Service, Application or via email. The Company may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability.

Notice:

The Company may give notice by means of a general notice on the Service or Application, or by electronic mail to your email address on record in the Company's account information, or by written communication sent by regular mail to your address on record in Company's account information.

Assignment:

You may not assign your rights under these User Terms without prior written approval of the Company.

Privacy and Cookie Notice:

The Company collects and processes the personal data of the visitors of the Website and users of the Application according to the Privacy and Cookie Notice

Excusable Delays (Force Majeure):

Neither party hereto shall be responsible for delays or failures in performance resulting from acts beyond its reasonable control and without its fault or negligence. Such excusable delays or failures may be caused by, among other things, strikes, lock-out, riots, rebellions, accidental explosions, floods, storms, acts of God and similar occurrences.

Miscellaneous:

  • All claims and disputes arising under this Terms and Conditions should be notified to the Company within 10 days from the event date after which no You shall have any claim against the Company.
  • The Company shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions The Company reserves the right to publish information of beneficiaries of any program, offer, scheme or any promotion.
  • The Customer who seeks to use or obtain any of the services, benefits, facilities and arrangements as offered by the Company's Partner, then the provisions of such services, benefits, facilities or arrangements will be subject to the respective terms and conditions of the said Service Provider, being the provider of the said services, benefits, facilities or arrangements.
  • This web site (https://www.lococabs.com) is published and maintained by SearchBox Technologies. The access, browsing or use of the facilities provided by this site constitutes a deemed acceptance, without limitation or qualification, of the terms and conditions as set forth herein below, by the user and constitutes an agreement between Company and the Customers.
